SMS Terms of Use
By “Opting In” to or using a “Text Message Service” (asdefined below) from National EAP, you accept these Terms & Conditions.
THIS AGREEMENT IS SUBJECT TO BINDING ARBITRATION AND AWAIVER OF CLASS ACTION RIGHTS AS DETAILED BELOW.
This agreement is between you and National EAP or one of itsaffiliates. All references to “National EAP,” “we,” “our,” or “us” refer toNational EAP, 490 Wheeler Road, Suite 102, Hauppauge, New York 11788
1. Definitions
“Opting In,” “Opt In,” and “Opt-In” refer to requesting,joining, agreeing to, enrolling in, signing up for, acknowledging, respondingto, or otherwise consenting to receive one or more text messages.
“Text Message Service” includes any arrangement or situation in which we sendone or more messages addressed to your mobile phone number, including textmessages (such as SMS, MMS, or successor protocols or technologies).
2. Consenting to text messaging
By consenting to receive text messages from us, you agreedto these Text Messaging Terms and Conditions, as well as our PrivacyPolicy, incorporated herein by reference.
3. E-Sign Disclosure
By agreeing to receive text messages, you also consent tothe use of an electronic record to document your agreement. You may withdrawyour consent to the use of the electronic record by replying STOP.
4. Flexible IT Text Message Service Privacy Policy
We respect your privacy. We only use information you providethrough this service to transmit your mobile messages and respond to you. Thisincludes, but isn’t limited to, sharing information with platform providers,phone companies, and other vendors who assist us in the delivery of mobilemessages.
Mobile information will not be shared with thirdparties/affiliates for marketing/promotional purposes. All the above categoriesexclude text messaging originator opt-in data and consent; this informationwill not be shared with any third parties.
Nonetheless, we reserve the right always to disclose anyinformation as necessary to satisfy any law, regulation or governmentalrequest, to avoid liability, or to protect our rights or property. This TextMessage Service Privacy Policy applies to your use of the Text Message Serviceand isn’t intended to modify our general
PrivacyPolicy, incorporated by reference above, which may govern the relationshipbetween you and us in other contexts.
5. Costs of text messages
We do not charge you for the messages you send and receivevia this text message service. But message and data rates may apply, sodepending on your plan with your wireless or other applicable provider, you maybe charged by your carrier or other applicable provider.
6. Frequency of text messages
This Text Messaging Service is for conversationalperson-to-person communication between you and our employees. We may send youan initial message providing details about the service. After that, the numberof text messages you receive will vary depending on how you use our servicesand whether you take steps to generate more text messages from us (such as bysending a HELP request).
7. Opting out of text messages
If you no longer want to receive text messages, you mayreply to any text message with STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, orUNSUBSCRIBE. As a person-to-person communication service, opt-out requests arespecific to each conversation between you and one of our employees and theirassociated phone number. After unsubscribing, we may send you confirmation ofyour opt-out via text message.

9. Binding arbitration, class action waiver, andseverability clauses
Any dispute arising out of or relating to these Terms shallbe resolved through binding arbitration on an individual basis. You waive anyright to bring or participate in a class action or class arbitration.
If any part of this agreement is found unenforceable, theremainder will remain in full force and effect.
